The short version
- You may use CalChime on your own iPhone.
- It is a convenience. An alarm can fail, so do not make it your only reminder for anything that really matters.
- Your Google account and calendar stay under Google’s terms.
- The app comes as it is, without guarantees.
1. These terms
CalChime is an iPhone app published on the App Store by Benjamin Haberman under the Confidere name (“Confidere”, “we”, “us”). These terms are an agreement between you and us. By installing or using CalChime you agree to them. If you do not agree, do not use the app.
How the app handles your information is covered separately, in the CalChime Privacy Policy.
2. Your license to use CalChime
We give you a personal, non-exclusive, non-transferable license, which we can withdraw, to install and use CalChime on Apple devices that you own or control.
The app remains ours. You may not copy it, sell it, rent it out, or change it, and you may not take it apart to get at its code, except where the law gives you a right to do so that these terms cannot remove.
3. CalChime Pro
CalChime is free to use. CalChime Pro is an optional paid upgrade that adds features. What it adds, and what it costs in your currency, is shown in the app before you buy. You can buy it in two ways. Both are bought inside the app, through Apple, with your Apple Account.
Yearly subscription
- If you are offered a free trial, you are not charged until it ends. Apple charges you when the trial ends unless you cancel at least 24 hours before then.
- With no trial, Apple charges you when you confirm the purchase.
- The subscription renews automatically every year, at the price shown when you bought it, until you cancel. To stop a renewal, cancel at least 24 hours before the current year ends.
- You cancel in your Apple Account settings, not in CalChime: open Settings on your iPhone, tap your name, then Subscriptions. Apple’s instructions are here. Deleting the app does not cancel a subscription.
- If you cancel, you keep CalChime Pro until the end of the period you have paid for.
- If the price is going to change, Apple will tell you beforehand, and where the law requires it, ask you to agree.
Lifetime purchase
- You pay once and there is no renewal.
- “Lifetime” means for as long as we offer CalChime. It is not a promise that the app will always exist. Section 8 covers what happens if we stop offering it.
- If you already have a yearly subscription and then buy lifetime, Apple does not cancel the subscription for you. Cancel it yourself so that you are not charged again.
When CalChime Pro ends
If your subscription ends, the app asks you what to do the next time you open it. It does not change your alarms until you choose. The free features stay available.
Refunds
Apple, not Confidere, handles payments and refunds. To ask for one, go to reportaproblem.apple.com. Nothing in these terms takes away a refund right the law gives you.
Restoring a purchase
If you reinstall CalChime or change phones, tap “Restore purchases” on the CalChime Pro screen while signed in with the same Apple Account.
4. Do not rely on CalChime alone
CalChime is a convenience tool. It sets iPhone alarms for your calendar events, but an alarm can fail to ring, or ring at the wrong time, for reasons that include:
- your iPhone is switched off or out of battery;
- you have withdrawn a permission the app needs, such as permission to set alarms or to read your calendar;
- your calendar changed and you have not opened the app since. CalChime updates its alarms when you open it;
- limits set by your iPhone or by iOS on what an app’s alarms can do;
- the app is still in testing, and software has faults.
So do not rely on CalChime as your only reminder for anything where a missed alarm could cause harm or loss. Medication, flights, court dates, exams, anything involving someone’s safety: keep a second reminder for those.
5. Your Google account
CalChime reads your Google Calendar and cannot change it. Your Google account and your calendar remain subject to Google’s own terms, and you are responsible for keeping to them. CalChime is not made by, endorsed by or affiliated with Google. Google Calendar is a trademark of Google LLC.
6. No warranty
CalChime is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:
- warranties of merchantability or fitness for a particular purpose;
- warranties that the app will be uninterrupted, timely, secure or error-free; and
- warranties that any alarm will ring, or will ring at the right time.
7. Limitation of liability
To the maximum extent permitted by applicable law:
- Confidere, its owner, employees and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities or goodwill, and including any loss that follows from an alarm that did not ring or rang at the wrong time.
- Our total aggregate liability for any claims arising from your use of CalChime shall not exceed the greater of (a) the amount you paid us for CalChime in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
8. Changes and ending
You can stop using CalChime at any time by deleting it. We may change the app, or stop offering it, at any time. Your license ends automatically if you break these terms.
If these terms change, the new version will be posted on this page with a new effective date. If you keep using CalChime after that date, you accept the new version.
9. App Store downloads
If you download CalChime from Apple’s App Store, Apple’s standard Licensed Application End User License Agreement also applies to your use of the app. Apple is not a party to these terms and is not responsible for the app or for supporting it.
10. Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any dispute arising from these terms or from your use of CalChime will be resolved exclusively in the state or federal courts located in New Jersey.
